Fees and Payment6.1 Booking confirmation will specify the total fee for Services.6.2 All fees are inclusive of VAT where applicable.6.3 Payment must be made as instructed in the confirmation email or text message, via the accepted payment methods.6.4 The Company reserves the right to refuse or cancel bookings at its discretion.7. Bookings, Cancellation, and Rescheduling7.1 Any cancellations or rescheduling requests should be made via your confirmation email or text message as soon as possible.7.2 Rescheduling• A minimum of 2 days (48 hours) notice is required to reschedule an appointment.
• Rescheduling with more than 2 days’ notice: the Deposit may be transferred to the new appointment date.
• Rescheduling with less than 2 days’ notice: the Deposit will be forfeited in full and treated as a late rescheduling charge.7.3 Cancellations• Cancellation with more than 2 days’ notice: the £40 Deposit remains non-refundable, but no additional Cancellation Fee applies.
• Cancellation within 2 days of the scheduled service: a Cancellation Fee of 25% of the total Service Fee plus the Deposit applies.
• Cancellation on the day of the service: a Cancellation Fee of 50% of the total Service Fee plus the Deposit applies.8. Limitations of Liability8.1 The Services consist of a visual inspection of the property and the preparation of a snagging report identifying defects and issues observed at the time of the inspection in reasonably accessible areas of the property. The inspection is non-invasive and does not involve moving furniture, lifting flooring, removing fixtures, or carrying out destructive testing.8.2 Whilst the Company will exercise reasonable skill and care in carrying out the Services, the inspection is limited in scope and the Company cannot guarantee that all defects, snags, or issues will be identified.8.3 The snagging report is prepared solely for the Client who commissioned the Service. The Company accepts no responsibility or liability to any third party who may rely on the report.8.4 The Company shall not be responsible for, and accepts no liability for, any loss, damage, cost, or expense arising from:
• any reliance placed on the report by any third party;
• any decision, negotiation, remedial works, or other action taken by the Client or any third party following the report;
• any defects, deterioration, or issues which arise, worsen, or become apparent after the date of the inspection; or
• any indirect, incidental, or consequential loss.8.5 Nothing in these Terms shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, or for fraud or fraudulent misrepresentation.8.6 Subject to clause 8.5, the Company’s total liability in connection with the Services shall not exceed the fees paid by the Client for the relevant Service.8.7 The Company shall remain liable for any direct physical damage to the Client’s property caused by the Company or its personnel while attending the property to carry out the Services.8.8 In relation to use of the Website, the Company does not guarantee that the Website will always be available or free from errors and shall not be liable for any temporary unavailability or inaccuracies in its content.9. In the absence of such written notice, the Client will be deemed to have provided consent.14. Termination14.1 Either party may terminate the engagement by providing written notice via email or other agreed communication method.14.2 Where termination is initiated by the Client, the cancellation and fee provisions set out in Section 7 shall continue to apply.14.3 Upon termination, the Client remains liable for fees for Services provided up to the date of termination.14.4 The Company reserves the right to terminate the engagement immediately, or to refuse to proceed with a service on the day, where in the Company’s reasonable opinion:
• The behaviour of the Client or any person present at the property is abusive, aggressive, threatening or inappropriate.
• The property or site presents a risk to health or safety.
• Animals are present and are not secured or removed from the areas to be inspected.
• Access to the property is restricted, unsafe or unlawful.14.5 Where the Company is unable to proceed with the service due to any of the circumstances set out in clause 14.4, this shall be treated as a cancellation on the day of the service by the Client and the applicable charges under Section 7.3 shall apply.15. Governing Law15.1 These Terms are governed by the laws of England and Wales.15.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.16. Entire Agreement and Amendments16.1 These Terms constitute the entire agreement between the Client and the Company regarding Services and supersede any prior agreements.16.2 Any amendments must be made in writing.
